`Uqba ibn Aws al-Sadusi

أَخْبَرَنِي يَحْيَى بْنُ حَبِيبِ بْنِ عَرَبِيٍّ، قَالَ أَنْبَأَنَا حَمَّادٌ، عَنْ خَالِدٍ، - يَعْنِي الْحَذَّاءَ - عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، عَنْ عَبْدِ اللَّهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَلاَ وَإِنَّ قَتِيلَ الْخَطَإِ شِبْهِ الْعَمْدِ مَا كَانَ بِالسَّوْطِ وَالْعَصَا مِائَةٌ مِنَ الإِبِلِ أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

It was narrated from Abdullah bin 'Amr that the prophet said:"Indeed the accidental killing, which seems intentional, with a whip or a stick, (the Diyah) is one hundred camels, of which forty should be (she-camels) with their young in their wombs

حَدَّثَنَا مُحَمَّدُ بْنُ كَامِلٍ، قَالَ حَدَّثَنَا هُشَيْمٌ، عَنْ خَالِدٍ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، عَنْ رَجُلٍ، مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم قَالَ خَطَبَ النَّبِيُّ صلى الله عليه وسلم يَوْمَ فَتْحِ مَكَّةَ فَقَالَ ‏ "‏ أَلاَ وَإِنَّ قَتِيلَ الْخَطَإِ شِبْهِ الْعَمْدِ بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ مِائَةٌ مِنَ الإِبِلِ فِيهَا أَرْبَعُونَ ثَنِيَّةً إِلَى بَازِلِ عَامِهَا كُلُّهُنَّ خَلِفَةٌ ‏"‏ ‏.‏

It was narrated from 'Uqbah bin Aws, that:a man from among the Companions of the Prophet delivered a speech on the Day of the Conquest of Makkah and said: 'Indeed the accidental killing, which seems international, with a whip, a stick, or a rock, (the Diyah) is one hundred camels, of which forty should be pregnant she-camels between the ages of six and nine years old, all in the middle of their pregnancies

أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ، عَنِ ابْنِ أَبِي عَدِيٍّ، عَنْ خَالِدٍ، عَنِ الْقَاسِمِ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَلاَ إِنَّ قَتِيلَ الْخَطَإِ قَتِيلَ السَّوْطِ وَالْعَصَا فِيهِ مِائَةٌ مِنَ الإِبِلِ مُغَلَّظَةٌ أَرْبَعُونَ مِنْهَا فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

It was narrated from 'Uqbah bin 'Aws, that the Mssenger of Allah said:"Indeed the accidental killing, the killing with a whip or stick, for it (the Diyah) is one hundred camels - a severe penalty - of which forty should be (she-camels) with their young in their wombs

أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ، قَالَ حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ يَعْقُوبَ بْنِ أَوْسٍ، عَنْ رَجُلٍ، مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمَّا دَخَلَ مَكَّةَ يَوْمَ الْفَتْحِ قَالَ ‏ "‏ أَلاَ وَإِنَّ كُلَّ قَتِيلِ خَطَإِ الْعَمْدِ أَوْ شِبْهِ الْعَمْدِ قَتِيلِ السَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

It was narrated from Ya'qub bin Aws, from a man among the Companions of the Prophet that:when the Messenger of Allah entered Makkah on the Day of the Conquest, he said: "Indeed, every accidental killing on purpose, or resembling on purpose - killing with a whip or stick, for it are forty (she-camels) which their young in their wombs

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ، قَالَ حَدَّثَنَا يَزِيدُ، قَالَ حَدَّثَنَا خَالِدٌ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ يَعْقُوبَ بْنِ أَوْسٍ، أَنَّ رَجُلاً، مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم حَدَّثَهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمَّا قَدِمَ مَكَّةَ عَامَ الْفَتْحِ قَالَ ‏ "‏ أَلاَ وَإِنَّ قَتِيلَ الْخَطَإِ الْعَمْدِ قَتِيلَ السَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

It was narrated from Ya'qub bin Aws that:a man from among the Companions of the Prophet told him, that when the Messenger of Allah came to Makkah, in the Year of the Conquest, he said: "Indeed, accidental killing on purpose, is killing with a whip or stick, for which forty (she-camels) with their young in their wombs

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ، قَالَ أَنْبَأَنَا يَزِيدُ، عَنْ خَالِدٍ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ يَعْقُوبَ بْنِ أَوْسٍ، أَنَّ رَجُلاً، مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم حَدَّثَهُ أَنَّ النَّبِيَّ صلى الله عليه وسلم دَخَلَ مَكَّةَ عَامَ الْفَتْحِ قَالَ ‏ "‏ أَلاَ وَإِنَّ قَتِيلَ الْخَطَإِ الْعَمْدِ قَتِيلَ السَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

It was narrated from Ya'qub bin Aws that:a man from among the Companions of the Prophet narrated to him that the Prophet entered Makkah during the Year of the Conquest, and said: 'Indeed, accidental killing on purpose, is killing with a whip or stick, for which forty (she-camels) with their young in their wombs

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، وَمُسَدَّدٌ، - الْمَعْنَى - قَالاَ حَدَّثَنَا حَمَّادٌ، عَنْ خَالِدٍ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم خَطَبَ يَوْمَ الْفَتْحِ بِمَكَّةَ فَكَبَّرَ ثَلاَثًا ثُمَّ قَالَ ‏"‏ لاَ إِلَهَ إِلاَّ اللَّهُ وَحْدَهُ صَدَقَ وَعْدَهُ وَنَصَرَ عَبْدَهُ وَهَزَمَ الأَحْزَابَ وَحْدَهُ ‏"‏ ‏.‏ إِلَى هَا هُنَا حَفِظْتُهُ عَنْ مُسَدَّدٍ ثُمَّ اتَّفَقَا ‏"‏ أَلاَ إِنَّ كُلَّ مَأْثُرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ تُذْكَرُ وَتُدْعَى مِنْ دَمٍ أَوْ مَالٍ تَحْتَ قَدَمَىَّ إِلاَّ مَا كَانَ مِنْ سِقَايَةِ الْحَاجِّ وَسِدَانَةِ الْبَيْتِ ‏"‏ ‏.‏ ثُمَّ قَالَ ‏"‏ أَلاَ إِنَّ دِيَةَ الْخَطَإِ شِبْهِ الْعَمْدِ مَا كَانَ بِالسَّوْطِ وَالْعَصَا مِائَةٌ مِنَ الإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏ وَحَدِيثُ مُسَدَّدٍ أَتَمُّ ‏.‏

Narrated Abdullah ibn Amr: (Musaddad's version has): The Messenger of Allah (ﷺ) made a speech on the day of the conquest of Mecca, and said: Allah is Most Great, three times. He then said: There is no god but Allah alone: He fulfilled His promise, helped His servant, and alone defeated the companies. (The narrator said:) I have remembered from Musaddad up to this. Then the agreed version has: Take note! All the merits mentioned in pre-Islamic times, and the claim made for blood or property are under my feet, except the supply of water to the pilgrims and the custody of the Ka'bah. He then said: The blood-money for unintentional murder which appears intentional, such as is done with a whip and a stick, is one hundred camels, forty of which are pregnant. Musaddad's version is more accurate

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، وَمُسَدَّدٌ، - الْمَعْنَى - قَالاَ حَدَّثَنَا حَمَّادٌ، عَنْ خَالِدٍ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم - قَالَ مُسَدَّدٌ - خَطَبَ يَوْمَ الْفَتْحِ - ثُمَّ اتَّفَقَا - فَقَالَ ‏"‏ أَلاَ إِنَّ كُلَّ مَأْثُرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ مِنْ دَمٍ أَوْ مَالٍ تُذْكَرُ وَتُدْعَى تَحْتَ قَدَمَىَّ إِلاَّ مَا كَانَ مِنْ سِقَايَةِ الْحَاجِّ وَسِدَانَةِ الْبَيْتِ ‏"‏ ‏.‏ ثُمَّ قَالَ ‏"‏ أَلاَ إِنَّ دِيَةَ الْخَطَإِ شِبْهِ الْعَمْدِ مَا كَانَ بِالسَّوْطِ وَالْعَصَا مِائَةٌ مِنَ الإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

Narrated Abdullah ibn Amr ibn al-'As: The Prophet (ﷺ) said: Musaddad's version has: He addressed on the day of Conquest. The agreed version then goes: Beware! Every object of pride of pre-Islamic times, whether it is blood-vengeance or property, mentioned or claimed, has been put under my feet except supply of water to the pilgrims and custody of the House (the Ka'bah). He then said: Beware! The blood-wit for unintentional murder, such as is done with a whip and stick, is one hundred camels, forty of which are pregnant

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، وَمُحَمَّدُ بْنُ جَعْفَرٍ، قَالاَ حَدَّثَنَا شُعْبَةُ، عَنْ أَيُّوبَ، سَمِعْتُ الْقَاسِمَ بْنَ رَبِيعَةَ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ قَتِيلُ الْخَطَإِ شِبْهِ الْعَمْدِ قَتِيلُ السَّوْطِ وَالْعَصَا مِائَةٌ مِنَ الإِبِلِ أَرْبَعُونَ مِنْهَا خَلِفَةً فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏ حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو، عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَهُ ‏.‏

It was narrated from Abdullah bin 'Amr that the Prophet (ﷺ) said:“Killing by mistake that resembles intentionally, is killing with a whip or stick, for which the blood money is one hundred camels, of which forty should be pregnant she-camels in middle of their pregnancies, with their young in their wombs.” Another chain reports a similar hadith
