Haram ibn Mhysa al-Ansari

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ مُحَيِّصَةَ، عَنْ أَبِيهِ، أَنَّهُ اسْتَأْذَنَ رَسُولَ اللَّهِ صلى الله عليه وسلم فِي إِجَارَةِ الْحَجَّامِ فَنَهَاهُ عَنْهَا فَلَمْ يَزَلْ يَسْأَلُهُ وَيَسْتَأْذِنُهُ حَتَّى أَمَرَهُ أَنِ اعْلِفْهُ نَاضِحَكَ وَرَقِيقَكَ ‏.‏

Narrated Muhayyisah ibn Ka'b: Muhayyisah asked permission of the Messenger of Allah (ﷺ) regarding hire of the cupper, but he forbade him. He kept on asking his permission, and at last he said to him: Feed your watering camel with it and feed your slave with it

حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ ثَابِتٍ الْمَرْوَزِيُّ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ، عَنْ أَبِيهِ، أَنَّ نَاقَةً، لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْهُ عَلَيْهِمْ فَقَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَلَى أَهْلِ الأَمْوَالِ حِفْظَهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ ‏.‏

Narrated Muhayyisah: The she-camel of Bara' ibn Azib entered the garden of a man and did damage to it. The Messenger of Allah (ﷺ) gave decision that the owners of properties are responsible for guarding them by day, and the owners of animals are responsible for guarding them by night

حَدَّثَنَا مَحْمُودُ بْنُ خَالِدٍ، حَدَّثَنَا الْفِرْيَابِيُّ، عَنِ الأَوْزَاعِيِّ، عَنِ الزُّهْرِيِّ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ الأَنْصَارِيِّ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ فَكُلِّمَ رَسُولُ اللَّهِ صلى الله عليه وسلم فِيهَا فَقَضَى أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا وَأَنَّ عَلَى أَهْلِ الْمَاشِيَةِ مَا أَصَابَتْ مَاشِيَتُهُمْ بِاللَّيْلِ ‏.‏

Narrated Al-Bara' ibn Azib: Al-Bara' had a she-camel which was accustomed to graze the standing crop belonging to the people. She entered a garden and did damage to it. The Messenger of Allah (ﷺ) was informed about it. So he gave decision that the owners of gardens are responsible for guarding them by day, and the owners of the animals are responsible for guarding them by night. Any damage done by animals during the night is a responsibility lying on their owners

حَدَّثَنَا قُتَيْبَةُ، عَنْ مَالِكِ بْنِ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ مُحَيِّصَةَ، أَخِي بَنِي حَارِثَةَ عَنْ أَبِيهِ، أَنَّهُ اسْتَأْذَنَ النَّبِيَّ صلى الله عليه وسلم فِي إِجَارَةِ الْحَجَّامِ فَنَهَاهُ عَنْهَا فَلَمْ يَزَلْ يَسْأَلُهُ وَيَسْتَأْذِنُهُ حَتَّى قَالَ ‏ "‏ اعْلِفْهُ نَاضِحَكَ وَأَطْعِمْهُ رَقِيقَكَ ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ رَافِعِ بْنِ خَدِيجٍ وَأَبِي جُحَيْفَةَ وَجَابِرٍ وَالسَّائِبِ بْنِ يَزِيدَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ مُحَيِّصَةَ حَدِيثٌ حَسَنٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ ‏.‏ وَقَالَ أَحْمَدُ إِنْ سَأَلَنِي حَجَّامٌ نَهَيْتُهُ وَآخُذُ بِهَذَا الْحَدِيثِ ‏.‏

Narrated Ibn Muhayyisah of Banu Harithah: From his father, that he sought permission from the Prophet (ﷺ) to take the wages for cupping and he (ﷺ) forbade him from it. He continued asking him and seeking his permission until he said: "Use it to give fodder to your water-carrying camels, and to feed your slaves." [He said:] There are narrations on this topic from Rafi' bin Khadij, Abu Juhaifah, Jabir, and As-Sa'ib bin Yazid. [Abu 'Eisa said:] The Hadith of Muhayyisah is a Hasan Sahih Hadith. This is acted upon according to some of the people of knowledge. Ahmad said: "If I am asked for something by cupper then I deny him, acting upon this Hadith

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا شَبَابَةُ بْنُ سَوَّارٍ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنِ الزُّهْرِيِّ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ، عَنْ أَبِيهِ، أَنَّهُ سَأَلَ النَّبِيَّ ـ صلى الله عليه وسلم ـ عَنْ كَسْبِ الْحَجَّامِ فَنَهَاهُ عَنْهُ فَذَكَرَ لَهُ الْحَاجَةَ فَقَالَ ‏ "‏ اعْلِفْهُ نَوَاضِحَكَ ‏"‏ ‏.‏

It was narrated from Haram bin Munayyisah that :his father asked the Prophet (ﷺ) about the earnings of a cupper and he forbade him from that. Then he mentioned his need and he said: "Spend it on feeding your she-camels that draw water

حَدَّثَنَا مُحَمَّدُ بْنُ رُمْحٍ الْمِصْرِيُّ، أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، أَنَّ ابْنَ مُحَيِّصَةَ الأَنْصَارِيَّ، أَخْبَرَهُ أَنَّ نَاقَةً لِلْبَرَاءِ كَانَتْ ضَارِيَةً دَخَلَتْ فِي حَائِطِ قَوْمٍ فَأَفْسَدَتْ فِيهِ فَكُلِّمَ رَسُولُ اللَّهِ صلى الله عليه وسلم فِيهَا فَقَضَى أَنَّ حِفْظَ الأَمْوَالِ عَلَى أَهْلِهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي مَا أَصَابَتْ مَوَاشِيهِمْ بِاللَّيْلِ ‏.‏ حَدَّثَنَا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ، حَدَّثَنَا مُعَاوِيَةُ بْنُ هِشَامٍ، عَنْ سُفْيَانَ، عَنْ عَبْدِ اللَّهِ بْنِ عِيسَى، عَنِ الزُّهْرِيِّ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، أَنَّ نَاقَةً، لآلِ الْبَرَاءِ أَفْسَدَتْ شَيْئًا فَقَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم بِمِثْلِهِ ‏.‏

It was narrated from Ibn Shihab that :Ibn Muhayyisah Al-Ansari told him that a she-camel belonging to Bara used to wander free. It entered a garden belonging to some people and caused some damage. The Messenger of Allah (ﷺ) was told of that, and he ruled that property was to be protected by its owners of livestock were responsible for any damage caused by their animals during the night
