`Amr ibn `Uthman al-'Umawi

حَدَّثَنَا أَصْبَغُ، قَالَ أَخْبَرَنِي ابْنُ وَهْبٍ، عَنْ يُونُسَ، عَنِ ابْنِ شِهَابٍ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ ـ رضى الله عنهما ـ أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ، أَيْنَ تَنْزِلُ فِي دَارِكَ بِمَكَّةَ‏.‏ فَقَالَ ‏"‏ وَهَلْ تَرَكَ عَقِيلٌ مِنْ رِبَاعٍ أَوْ دُورٍ ‏"‏‏.‏ وَكَانَ عَقِيلٌ وَرِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٌ وَلَمْ يَرِثْهُ جَعْفَرٌ وَلاَ عَلِيٌّ ـ رضى الله عنهما ـ شَيْئًا لأَنَّهُمَا كَانَا مُسْلِمَيْنِ، وَكَانَ عَقِيلٌ وَطَالِبٌ كَافِرَيْنِ، فَكَانَ عُمَرُ بْنُ الْخَطَّابِ ـ رضى الله عنه ـ يَقُولُ لاَ يَرِثُ الْمُؤْمِنُ الْكَافِرَ‏.‏ قَالَ ابْنُ شِهَابٍ وَكَانُوا يَتَأَوَّلُونَ قَوْلَ اللَّهِ تَعَالَى ‏{‏إِنَّ الَّذِينَ آمَنُوا وَهَاجَرُوا وَجَاهَدُوا بِأَمْوَالِهِمْ وَأَنْفُسِهِمْ فِي سَبِيلِ اللَّهِ وَالَّذِينَ آوَوْا وَنَصَرُوا أُولَئِكَ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ‏}‏ الآيَةَ‏.‏

Narrated 'Usama bin Zaid:I asked, "O Allah's Messenger (ﷺ)! Where will you stay in Mecca? Will you stay in your house in Mecca?" He replied, "Has `Aqil left any property or house?" `Aqil along with Talib had inherited the property of Abu Talib. Jafar and `Ali did not inherit anything as they were Muslims and the other two were non-believers. `Umar bin Al-Khattab used to say, "A believer cannot inherit (anything from an) infidel." Ibn Shihab, (a sub-narrator) said, "They (`Umar and others) derived the above verdict from Allah's Statement: "Verily! those who believed and Emigrated and strove with their life And property in Allah's Cause, And those who helped (the emigrants) And gave them their places to live in, These are (all) allies to one another

حَدَّثَنَا مَحْمُودٌ، أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ بْنِ عَفَّانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، قَالَ قُلْتُ يَا رَسُولَ اللَّهِ، أَيْنَ تَنْزِلُ غَدًا فِي حَجَّتِهِ‏.‏ قَالَ ‏"‏ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مَنْزِلاً ‏"‏‏.‏ ثُمَّ قَالَ ‏"‏نَحْنُ نَازِلُونَ غَدًا بِخَيْفِ بَنِي كِنَانَةَ الْمُحَصَّبِ، حَيْثُ قَاسَمَتْ قُرَيْشٌ عَلَى الْكُفْرِ ‏"‏‏.‏ وَذَلِكَ أَنَّ بَنِي كِنَانَةَ حَالَفَتْ قُرَيْشًا عَلَى بَنِي هَاشِمٍ أَنْ لاَ يُبَايِعُوهُمْ وَلاَ يُئْوُوهُمْ‏.‏ قَالَ الزُّهْرِيُّ وَالْخَيْفُ الْوَادِي‏.‏

Narrated Usama bin Zaid:I asked the Prophet (ﷺ) during his Hajj, "O Allah's Messenger (ﷺ)! Where will you stay tomorrow?" He said, "Has `Aqil left for us any house?" He then added, "Tomorrow we will stay at Khaif Bani Kinana, i.e. Al-Muhassab, where (the Pagans of) Quraish took an oath of Kufr (i.e. to be loyal to heathenism) in that Bani Kinana got allied with Quraish against Bani Hashim on the terms that they would not deal with the members of this tribe or give them shelter." حَدَّثَنَا سُلَيْمَانُ بْنُ عَبْدِ الرَّحْمَنِ، حَدَّثَنَا سَعْدَانُ بْنُ يَحْيَى، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، أَنَّهُ قَالَ زَمَنَ الْفَتْحِ يَا رَسُولَ اللَّهِ، أَيْنَ تَنْزِلُ غَدًا قَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ مَنْزِلٍ ‏"‏‏.‏ ثُمَّ قَالَ ‏"‏ لاَ يَرِثُ الْمُؤْمِنُ الْكَافِرَ، وَلاَ يَرِثُ الْكَافِرُ الْمُؤْمِنَ ‏"‏‏.‏ قِيلَ لِلزُّهْرِيِّ وَمَنْ وَرِثَ أَبَا طَالِبٍ قَالَ وَرِثَهُ عَقِيلٌ وَطَالِبٌ‏.‏ قَالَ مَعْمَرٌ عَنِ الزُّهْرِيِّ أَيْنَ تَنْزِلُ غَدًا‏.‏ فِي حَجَّتِهِ، وَلَمْ يَقُلْ يُونُسُ حَجَّتِهِ وَلاَ زَمَنَ الْفَتْحِ‏.‏

Narrated `Amr bin `Uthman:Usama bin Zaid said during the Conquest (of Mecca), "O Allah's Messenger (ﷺ)! Where will we encamp tomorrow?" The Prophet (ﷺ) said, "But has `Aqil left for us any house to lodge in?" He then added, "No believer will inherit an infidel's property, and no infidel will inherit the property of a believer." Az- Zuhri was asked, "Who inherited Abu Talib?" Az-Zuhri replied, "Aqil and Talib inherited him

حَدَّثَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ ـ رضى الله عنهما ـ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يَرِثُ الْمُسْلِمُ الْكَافِرَ، وَلاَ الْكَافِرُ الْمُسْلِمَ ‏"‏‏.‏

Narrated Usama bin Zaid:the Prophet (ﷺ) said, "A Muslim cannot be the heir of a disbeliever, nor can a disbeliever be the heir of a Muslim

حَدَّثَنِي أَبُو الطَّاهِرِ، وَحَرْمَلَةُ بْنُ يَحْيَى، قَالاَ أَخْبَرَنَا ابْنُ وَهْبٍ، أَخْبَرَنَا يُونُسُ، بْنُ يَزِيدَ عَنِ ابْنِ شِهَابٍ، أَنَّ عَلِيَّ بْنَ حُسَيْنٍ، أَخْبَرَهُ أَنَّ عَمْرَو بْنَ عُثْمَانَ بْنِ عَفَّانَ أَخْبَرَهُ عَنْ أُسَامَةَ بْنِ زَيْدِ بْنِ حَارِثَةَ، أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ أَتَنْزِلُ فِي دَارِكَ بِمَكَّةَ فَقَالَ ‏ "‏ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ رِبَاعٍ أَوْ دُورٍ ‏"‏ ‏.‏ وَكَانَ عَقِيلٌ وَرِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٌ وَلَمْ يَرِثْهُ جَعْفَرٌ وَلاَ عَلِيٌّ شَيْئًا لأَنَّهُمَا كَانَا مُسْلِمَيْنِ وَكَانَ عَقِيلٌ وَطَالِبٌ كَافِرَيْنِ ‏.‏

Usama b. Zaid b. Haritha (Allah be pleased with him) said to Allah's Messenger (ﷺ):Will you stay in your house at Mecca (which you abandoned at the time of migration)? Thereupon he said: Has 'Aqil left for as any land or house? And 'Aqil and Talib became the Inheritors of Abu Talib's (property), and neither Ja'far nor 'Ali inherited anything from him, for both (Ja'far and 'Ali) were Muslims whereas 'Aqil and Talib were non-Muslims

حَدَّثَنَا مُحَمَّدُ بْنُ مِهْرَانَ الرَّازِيُّ، وَابْنُ أَبِي عُمَرَ، وَعَبْدُ بْنُ حُمَيْدٍ، جَمِيعًا عَنْ عَبْدِ، الرَّزَّاقِ - قَالَ ابْنُ مِهْرَانَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ، - عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، قُلْتُ يَا رَسُولَ اللَّهِ أَيْنَ تَنْزِلُ غَدًا وَذَلِكَ فِي حَجَّتِهِ حِينَ دَنَوْنَا مِنْ مَكَّةَ ‏.‏ فَقَالَ ‏ "‏ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مَنْزِلاً ‏"‏ ‏.‏

Usama b. Zaid (Allah be pleased with him) said:Allah's Messenger, God willing, where will you stay tomorrow? And it was at the time of the Conquest (of Mecca). Thereupon he (the Holy Prophet) said: Has 'Aqil left any accommodation for us?

وَحَدَّثَنِيهِ مُحَمَّدُ بْنُ حَاتِمٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ، وَزَمْعَةُ، بْنُ صَالِحٍ قَالاَ حَدَّثَنَا ابْنُ شِهَابٍ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ، بْنِ زَيْدٍ أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ أَيْنَ تَنْزِلُ غَدًا إِنْ شَاءَ اللَّهُ وَذَلِكَ زَمَنَ الْفَتْحِ ‏.‏ قَالَ ‏ "‏ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ مَنْزِلٍ ‏"‏ ‏.‏

Narrated Usama b. Zaid :Usama b. Zaid (Allah be pleased with him) said: Allah's Messenger, God willing, where will you stay tomorrow? Thereupon he (the Holy Prophet) said: Has 'Aqil left any accommodation for us?

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، وَأَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ - وَاللَّفْظُ لِيَحْيَى - قَالَ يَحْيَى أَخْبَرَنَا وَقَالَ الآخَرَانِ، حَدَّثَنَا ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ، حُسَيْنٍ عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلاَ يَرِثُ الْكَافِرُ الْمُسْلِمَ ‏"‏ ‏.‏

Usama b. Zaid reported Allah's Messenger (ﷺ) as saying:A Muslim is not entitled to inherit from a non-Muslim, and a non-Muslim is not entitled to inherit from a Muslim

حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، قَالَ قُلْتُ يَا رَسُولَ اللَّهِ أَيْنَ تَنْزِلُ غَدًا فِي حَجَّتِهِ قَالَ ‏"‏ هَلْ تَرَكَ لَنَا عَقِيلٌ مَنْزِلاً ‏"‏ ‏.‏ ثُمَّ قَالَ ‏"‏ نَحْنُ نَازِلُونَ بِخَيْفِ بَنِي كِنَانَةَ حَيْثُ قَاسَمَتْ قُرَيْشٌ عَلَى الْكُفْرِ ‏"‏ ‏.‏ يَعْنِي الْمُحَصَّبَ وَذَلِكَ أَنَّ بَنِي كِنَانَةَ حَالَفَتْ قُرَيْشًا عَلَى بَنِي هَاشِمٍ أَنْ لاَ يُنَاكِحُوهُمْ وَلاَ يُبَايِعُوهُمْ وَلاَ يُئْوُوهُمْ ‏.‏ قَالَ الزُّهْرِيُّ وَالْخَيْفُ الْوَادِي ‏.‏

Usamah bin Zaid said I asked Apostle of Allaah(ﷺ) where will you encamp tomorrow? (This is asked on the occasion of his Hajj). He replied “Did ‘Aqil leave any house for us?” He again said “We shall encamp in the valley (Khaif) of Banu Kinanah where the Quraish took an oath upon disbelief, that is, Al Muhassab.” The oath was that Banu Kinanah concluded a pact with the Quraish against Banu Hashim “they would have no marital relationship with them, nor would give them accommodation nor would have any commercial ties with them.” Al Zuhri said Al Khaif means valley

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلاَ الْكَافِرُ الْمُسْلِمَ ‏"‏ ‏.‏

Narrated Usamah b. Zaid:The Prophet (ﷺ) as saying: A Muslim may not inherit from an infidel nor an infidel from a Muslim
